Collier Family Lawyers Cairns: Frequently Asked Questions.
When should I contact a Family Lawyer? The sooner the better! Even before separation, people call us to get advice on how to protect assets in the event of a messy divorce. The sooner you get the advice you need, the sooner you can start getting on with what needs to be done to sort out your family law matters. We will discuss your situation and give you a checklist to help you make the process easier.
Do I really need a Family lawyer? Can’t I do it myself? You may be tempted not to get legal advice because you think it is expensive or not really necessary. You are at risk of making mistakes if you don’t get legal advice. This could prove to be costly!
You really do need to know whether you are on the right track with what you think you are entitled to and what might be done if you end up before a judge. Sometimes you need to choose your battles and not waste your time or money fighting over something that you won’t get. With a property settlement you will need to know the process to working it all out and what you are entitled to. It is important to understand the legal process and how it works.
Every case is different and just because your mate got a certain outcome doesn’t mean you will. There is a lot of information available. You shouldn’t try to diagnose your problem yourself from Google. It is worthwhile to spend a small amount to get good advice.
Can I save money on my legal fees? How can I manage fees? YES! Our time is your money in the legal world. Most lawyers charge according to the time they spend in your file. This means that the more time your lawyer spends working on your file, then the more it will cost you.
Collier Family Law understands that money is tight. We want to give you the best value for your money. This is why we will suggest to you that you can do some of the legwork yourself – as this will reduce your fees.
You can, for example, write your story. It might be therapeutic! If the matter is property related, you can gather all your financial records and prepare them for us. We also have an automated letter of instruction which you fill in, and it gives us the background we need from you to give you advice. You doing this yourself will save at least an hour of time.
Another time-saver is to have my clients fill out documents in draft so I can check them over. Or they can make their own enquiries if they want, such as getting three quotes from a valued. The more you can do, the less I need to, which reduces your fees.
Remember that your Cairns family lawyer must give you a fair estimate of fees at the beginning of your engagement. They will continue to give you additional estimates throughout the life and development of your file. Ask why this is not covered at your first appointment.
Is it easy to obtain a consent order?
Yes it really is quite a simple process. The hard part is usually reaching the agreement in the first place! But once you’ve done that, filling in an application for consent orders is reasonably straightforward. The ‘do-it-yourself’ person will find it difficult in two areas. First, there are sections of the form that are more complicated than others and may require legal advice. The second requirement is that consent orders applications must be accompanied with minutes of order. This allows you to outline the orders you wish the court will make. This part is where you will need to have some legal expertise in order for the court to properly word the orders and not miss anything.
